Welcome to Munchkin Meals ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Munchkin Meals mobile application (the "App") and related services (collectively, the "Service"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use Munchkin Meals. Users under 18 must have parental or guardian consent. By using the App, you represent that you meet this age requirement and are legally capable of entering into a binding agreement.

2. Description of Service

Munchkin Meals provides parents and caregivers with tools for family meal planning. Features may include recipe recommendations, weekly meal planning, dinner planning, shopping list management, an AI-powered meal assistant (MunchBot), and lunchbox photo journaling.

 

We may update, modify, or discontinue parts of the Service at any time without prior notice.

 

3. User Accounts & Subscriptions

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, complete, and up-to-date information;

• Keep your login credentials secure; and

• Notify us immediately of any unauthorized access to your account.

 

We reserve the right to suspend or terminate accounts that violate these Terms.

 

You may request deletion of your account at any time by contacting us at support@munchkinmeals.com. Upon deletion, your data will be handled in accordance with our Privacy Policy.

4. Guest Mode

You may use certain features of the App without creating an account ("Guest Mode"). In Guest Mode, all data (meal plans, foods, shopping lists) is stored locally on your device only. This data is not backed up to the cloud and may be permanently lost if you uninstall the App or clear your device storage. We are not responsible for any loss of locally stored guest data. To back up your data, you must create an account.

5. User Content

You may be able to upload, post, or share content such as photos, meal plans, or food notes ("User Content"). By submitting User Content, you grant Munchkin Meals a worldwide, royalty-free, perpetual, and transferable license to use, display, reproduce, and distribute such content for the purpose of operating and improving the Service.

 

You are responsible for your User Content and agree not to post any material that is:

• False, misleading, or deceptive;

• Infringing on intellectual property rights;

• Offensive, obscene, or inappropriate; or

• In violation of any applicable law.

We reserve the right to remove or moderate User Content at our discretion.

6. Feedback and Suggestions

If you provide us with feedback, ideas, or suggestions about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose, including improving the Service, without any obligation to compensate you.

7. Nutrition and Health Disclaimer

The content provided in Munchkin Meals is for informational purposes only and should not replace professional medical or nutritional advice. Always consult a qualified healthcare provider before making dietary changes for your child. We are not responsible for any health outcomes resulting from the use of the Service.

Regarding MunchBot AI Suggestions:

• MunchBot provides automated recipe suggestions, meal ideas, and planning assistance.

• All suggestions are for informational purposes only; we do not guarantee nutritional completeness or suitability for any specific dietary or medical condition.

• Use your own judgment and consult a qualified professional for dietary or health-related decisions.

• MindMap Ventures LLC is not liable for any damages arising from reliance on AI-generated suggestions.

8. Intellectual Property

All content, design, logos, and materials available in the App are owned by or licensed to Munchkin Meals and are protected under copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Prohibited Uses

You agree not to:

• Use the App for unlawful or unauthorized purposes;

• Attempt to gain unauthorized access to our systems or data;

• Interfere with the operation, security, or performance of the Service;

• Reverse engineer, decompile, copy, or redistribute the App;

• Share your account credentials outside your household or family group; or

• Use automated tools, bots, or scrapers in connection with the Service.

10. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by Munchkin Meals. We are not responsible for the content, policies, or practices of any third-party services. Please review their terms and privacy policies before use.

11. User Data, Cloud Storage & Privacy

• Free and Guest accounts store data locally on your device only.

• Pro plan accounts store data in the cloud (via Supabase) for cross-device sync and backup.

• We do not collect sensitive personal data (such as medical records or financial information) beyond the information you voluntarily enter into the App.

• Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please read it carefully.

12. Subscription and Payments

Some features of Munchkin Meals require a paid subscription. You agree to pay all applicable fees as described at the time of purchase. Plans:

• Monthly Pro Plan: $4.99/month

• Yearly Pro Plan: $39.99/year

 

Billing: Handled via the Apple App Store and RevenueCat. Payments, renewals, and cancellations are managed by the App Store. Please refer to Apple's subscription management options in your device settings.

 

Cancellation and Refunds: Subscriptions can be cancelled at any time via your Apple account settings. Refunds are subject to Apple's refund policies; we do not provide refunds outside of Apple's platform.

 

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, if we believe you have violated these Terms or engaged in fraudulent or abusive activity. Upon termination, your right to use the Service ceases immediately.

14. Disclaimers & Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied. MindMap Ventures LLC disclaims all warranties, including but not limited to warranties of accuracy, completeness, merchantability, or fitness for a particular purpose.

 

To the maximum extent permitted by law, MindMap Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service, including reliance on meal planning, AI suggestions, or recipes. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless MindMap Ventures LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your User Content.

16. Dispute Resolution

We encourage you to contact us first at support@munchkinmeals.com to resolve any dispute informally.

If a dispute cannot be resolved informally, you and Munchkin Meals agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

• Class Action Waiver: You agree to resolve disputes on an individual basis only. You may not bring claims as a plaintiff or class member in any class or representative action.

• Small Claims Exception: Either party may bring an individual claim in small claims court for disputes within that court's jurisdiction.

 

Nothing in this section limits either party's ability to seek injunctive or other equitable relief for violations of intellectual property rights.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, without regard to conflict of law principles. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Massachusetts.

18. License Grant

MindMap Ventures LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial household use, subject to these Terms.

 

Apple, Inc. is not a party to these Terms and bears no responsibility for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

19. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide notice via email or an in-App notification prior to the change taking effect. The updated version will also be posted in the App with a revised "Last Updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
